MARC’S Auto Rentals Terms and Conditions:
1) ‘Renter’ must have a valid Driver’s license at the time of rental.
2) Full payment is to be made by the ‘Renter’ to MARC’S Enterprises at the time of rental.
3) The deposit lodged will be refunded to the ‘Renter’ upon return of vehicle. However, if any part of the vehicle is lost, stolen or damaged the deposit will be used by MARC Enterprises to offset expenses incurred with the difference being returned to the ‘Renter’. If the expenses to fix the vehicle exceeds the deposited amount, the ‘Renter’ must pay the owner the difference at the time of returning the vehicle.
4) ‘Renter’ is required to return the vehicle by the date and time stipulated. Failure to do so will result in additional charges of US$5: or GYD$1,000: per hour.
5) Should the ‘Renter’ return the vehicle before the agreed rental period, the difference in the rental amount will be forfeited by the ‘Renter’.
6) Vehicles are rented from three (3) days and above.
7) The vehicle is expected to be returned in the same condition as it was given to the ‘Renter’. The gas should be at the same level as it was given.
8) Should the vehicle being rented have any accident(s) the ‘Renter’ is required to pay for all expenses (not covered by the insurance company) incurred for repairs and pay MARC Enterprises the full rental price per day for each day the vehicle is out of service. The owner will also decide the place and body work man to fix the vehicle and not the renter.
9) Regardless of Insurance coverage, the Renter shall fully indemnify MARC Enterprises for any loss, damage, and legal actions, including reasonable attorney’s fees that MARC Enterprises suffers due to the Renter’s use of the vehicle during the term of this agreement, including but not limited to, damage to the vehicle, damage to the property of others, injury to driver, and injury to others. This provision survives the termination of this Agreement.
10)At no time the ‘Renter’ must drink and drive the vehicle rented.
11) At no time the ‘Renter’ should be smoking in the vehicle rented.
12) The vehicle must not be used by the ‘Renter’ for any illegal transactions, robberies, soliciting or any other activity that may be deemed illegal by the laws of Guyana. Should the vehicle operate in violation of the Laws of Guyana, the Renter is responsible for all associated, tickets, fines and fees.
13)The Renter is advised that the vehicle is equipped with a tracker and once the Renter does not comply with the speed limit of 80km maximum as set by MARC Enterprises, an initial warning will be issued. Should the Renter continue to drive the vehicle above the set speed limit, a final warning will be issued after which MARC Enterprises reserves the right to shut down and seize the vehicle without refunding any of the rental fees (except the security deposit).
14)Only the ‘Renter’ is authorized to drive the vehicle rented and at no time must allow any other individual to drive the said vehicle.
15)The Renter must not use the vehicle to push or tow another vehicle.
16)The Renter must not use the vehicle for any race or competition.
17)The Renter must not operate the vehicle in a negligent manner.
Vehicle Rental Booking Agreement
Conditions stipulated by MARC’S Auto Rentals:
- All vehicles are rented from three (3) days and above.
- Security deposit to be paid in full at the date and time the vehicle is being uplifted.
- Cancellation of vehicle rental by the Booker 72 hours before the commencement of the rental date, 100% of the Deposit will be refunded.
- Cancellation of vehicle rental by the Booker less than 72 hours and up to 48 hours before the commencement of the rental date, 50% of the Deposit will be refunded.
- Cancellation of vehicle rental by the Booker less than 48 hours before the commencement of the rental date, NO Deposit will be refunded.
- Failure to uplift the vehicle on the ‘Date of Commencement of Rental’ stated above will result in the ‘Deposit Made’ to be forfeited.
Owner Warranty
The Owner guarantees that a vehicle which is in sound and safe condition and free of any known faults or defects that would affect its safe operation under normal use will be available for rental at the date specified by the Booker.
I/We the ‘Booker’ has read the entire Vehicle Rental Booking Agreement and has agreed to the conditions necessary for Booking and subsequent rental of a vehicle.
